LPAT Approves Clearview Application and Reduced Parking in Burlington

*NOTE: The Local Planning Appeal Tribunal (LPAT) released its decision regarding an appeal on the Clearview development application. Please see below a joint statement by me and Ward 1 Councillor Kelvin Galbraith.The Local Planning Appeal Tribunal (LPAT) has approved the application for a 7-storey building at 1085 Clearview Ave. with reduced parking rates.Though City of Burlington staff had supported the overall application, they did not support the reduced parking rates.  The City’s parking rate is 1.25 spaces per unit, while the applicant proposed 1.1 spaces. The city’s required parking could have been achieved through increasing parking supply, or reducing the number of units and/or height of the building.In its decision, the LPAT noted the property is suitable for intensification and reduced parking rates given the proximity within 250 m of the Aldershot GO Station Major Transit Station Area (MTSA). The Provincial growth plan and City and Regional official plans call for intensification around MTSAs and reduced parking standards to support such development.The City acknowledged the existing parking standards in the City Zoning Bylaw are outdated, and agreed further study needs to be done for parking within Intensification Areas.You can read the full LPAT decision here: LPAT-Clearview Decision-PL190378-JAN-29-2021.This project now proceeds to the site plan stage, where items such as vegetation, lighting and driveways can be discussed. The site plan has been undelegated from staff to Council for approval, providing an opportunity for community input.When the project moves into the construction phase, a construction management plan will be developed covering such items as dust mitigation, haul routes, contractor parking and more. These plans will be posted online for residents, including on-site contact information.OUR TAKE:We know this news will be disappointing to the Clearview area residents, especially given the potential to reduce the project to meet the City’s parking standards, thereby better reflecting community input for a smaller structure.We hope the community will continue to provide input as this moves into the site plan stage and ultimately construction phase.
