Heritage Designation for 795 Brant St. & 6 Downtown Burlington Properties Added to Heritage Register for Review

I’m pleased Council unanimously voted for heritage designation of 795 Brant St. at our meeting on Dec. 13.This decision reflects the staff recommendation and two independent studies -- one commissioned by the owner -- that found this site is worthy of heritage designation. That protects it from demolition, but allows it to be incorporated into their proposed redevelopment.We can protect heritage and support new developments at the same time; this has already occurred at two sites in the downtown, and achieves our City's goals to both protect heritage and build housing for a growing community.The City of Burlington also provides renovation grants and tax rebates to assist applicants with heritage preservation.Please click the links to read the staff report and related appendices, and view the staff presentation.Six Downtown Properties Added to Heritage RegisterI’m also pleased Council supported, through a majority vote, adding a number of other properties to Burlington’s Heritage Register.This is not the same as a heritage designation.Placing them on the Register simply buys the City time (60 days) if a demolition request is received to assess whether or not the demolition should be granted or the building protected.The properties that were added to the register are in one of the five downtown Cultural Heritage Landscape areas currently under review. Adding them to the register protects them from demolition while the study is ongoing. It will be concluded at the end of 2023 and we will have an opportunity to reevaluate whether or not to keep them on the register.Please click the links to read the staff report and related appendices, and view the staff presentation.Below are the motions that were approved by Council.Heritage Designation for 795 Brant Street (unanimous approval):State an intention to designate the property at 795 Brant Street under Part IV, Section 29 of the Ontario Heritage Act in accordance with the Heritage Evaluation of 795 Brant Street prepared by AECOM, dated November 23, 2022; andDirect the Director of Community Planning to provide notice of Council’s intention to designate 795 Brant Street, in accordance with section 29 (3) and 29 (4) of the Ontario Heritage Act; andDirect the City Clerk to present the draft designation by-law to Council for approval within 120 days after the date of publication of the notice of intention to designate 795 Brant Street, provided there is no objection or withdrawal; andDirect the City Clerk to take the necessary actions in the event of any objection to the notice of intention to designate pursuant to Part IV of the Ontario Heritage Act, sections 29 (5) and 29 (6).Inclusion of Downtown Properties on Burlington's Heritage Register (5-1 majority approval):Direct the Director of Community Planning to add the following list of properties to the Municipal Heritage Register and provide notice to the owner of the property within 30 days, pursuant to section 27(5) of the Ontario Heritage Act, R.S.O. 1990, c. O.18:

353-355 Brant St2010 Maria St468 Elizabeth St441 Elizabeth St436 Pearl S488 Locust St; andAuthorize the City Clerk to take necessary action if there are any objections in accordance with Section 27(7) of the Ontario Heritage Act, R.S.O. 1990, Chapter 0.18 and report back no later than 120 days after notices are sent out presenting all the objections received; andFollowing completion of the Downtown Cultural Heritage Landscapes Study, direct the Director of Community Planning to re-assess the eligibility of the above listed properties for continued inclusion on the Heritage Register and report back to City Council with a recommendation.Direct staff to conduct an assessment of the heritage value of 488 Locust Street and report back to the Community Planning, Regulation and Mobility (CPRM) Committee in February 2023.RELATED LINK:
